Filing a notice of claimed infringement
If you believe that material on the Site infringes a copyright you own or control, you may submit a written notice to our Designated Copyright Agent. Your notice must include all of the following:
- Your physical or electronic signature, or that of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed. If multiple works at the Site are covered by a single notification, a representative list of those works.
- Identification of the material claimed to be infringing, with sufficient detail to permit us to locate it on the Site (URL or specific page reference is most helpful).
- Your contact information, including name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the copyright owner's behalf.
Notices that do not substantially comply with all of the above requirements may not be effective.
Counter-notification
If you believe that material on the Site that has been removed or disabled in response to a DMCA notice was misidentified or removed in error, you may submit a counter-notification to our Designated Copyright Agent. Your counter-notification must include all of the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or disabled and the location at which it appeared before being removed or disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, the federal district court for any judicial district in which Drake Residential Group or its hosting service may be found), and that you will accept service of process from the person who provided the original infringement notice or that person's agent.
Repeat infringer policy
We will, in appropriate circumstances and in our sole discretion, terminate the access of any user who is a repeat infringer of intellectual property rights.
Misrepresentations
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages.
